Terms of Service

A business owner is the person or business that signs up for Fotemo and runs events with it.
The service
Fotemo provides tools for business owners to run event photo experiences, including guest photo collection, AI styling, event management, orders, printing workflows and related business features. Features may change as the service develops. Fotemo is the platform. The business owner is responsible for the physical magnet, printing and delivery.
Business owner accounts
Business owners must provide accurate account information, keep login credentials secure and use their account only for authorised purposes. Business owners are responsible for activity carried out through their account.
Free trial and pricing
Fotemo may offer a free trial. Trial limits, event prices, included AI photos and AI photo pack prices are shown in the app and before you pay. The price and terms shown when you confirm a purchase apply to that purchase. Pricing may be updated for future purchases.
Payment
Paid events and AI photo packs must be purchased using the payment method offered in the application. A purchase may remain pending until it is approved or otherwise confirmed by Fotemo. Business owners should not treat a pending payment as an active entitlement until the application confirms it. If a payment succeeds but the event or AI photos are not added, contact hello@myfotemo.com with the event and payment details so we can investigate.
Guest notice and consent
The business owner running an event is responsible for informing guests that their details and photos may be collected and processed, explaining the relevant event experience, and obtaining any consent required by law. Business owners must provide appropriate notice to parents or guardians where a guest is under 18.
Acceptable use
Business owners must not use Fotemo to upload or process unlawful, abusive, infringing or harmful content. Do not upload another person's photo without the necessary permission. Do not knowingly process photos of minors without parent or guardian consent. Business owners are responsible for ensuring that their event content and instructions comply with applicable law.
Content ownership and licence
Business owners and guests retain their rights in photos they provide. By using Fotemo, you grant Fotemo a limited licence to host, reproduce, transmit, transform and otherwise process submitted photos only as needed to provide, secure, support and improve the requested service features, including AI image creation.
AI output
AI-generated images are produced automatically and may contain inaccuracies, unexpected visual changes or other imperfections. Business owners and guests should review outputs before relying on them. Fotemo does not guarantee that an AI output will exactly match the original photo or the requested style. Guests are never charged for AI. If AI is paused or used up for an event, guests can still order a magnet from their original photo. AI photos and credits are not transferable between accounts or events unless Fotemo allows it.
Availability
We aim to keep the service available, but access may be interrupted by maintenance, network problems, third-party services, security events or other circumstances outside our reasonable control.
Suspension or termination
We may suspend or restrict an account or event where necessary for security, unlawful use, misuse, payment issues, protection of other users, or violation of these terms. Business owners may stop using the service at any time, subject to outstanding payment and other obligations.
Liability limit
To the maximum extent permitted by applicable law, Fotemo will not be liable for indirect, incidental, special, consequential or loss-of-profit damages arising from use of the service. To the maximum extent permitted by law, Fotemo's aggregate liability for a claim relating to the service will not exceed the amount the business owner paid to Fotemo for the affected service in the 12 months before the event giving rise to the claim.
Governing law
These terms are governed by the laws of India. Courts of India will have jurisdiction, subject to applicable law.
Changes to these terms
We may update these terms as the service changes. The updated version will be posted on this page with a new “Last updated” date. Business owners may be asked to accept updated terms before creating events or making purchases.
